Online Home Listings Legal

SF Gate: “The burgeoning online real estate industry has scored an important victory in California as a federal judge ruled it is unconstitutional for the state Department of Real Estate to require ForSaleByOwner.com to obtain a broker’s license in order to advertise home listings.”

This is really good news for anyone wanting to start a web based real estate listing company.

  • I’m not familiar with California laws, but in Missouri print publications that make their main business FSBO advertising DO have to have a real estate license. Newspapers do sell FSBO advertising, but it’s not their main business. I’m not arguing the good or bad of the law, but it’s not discriminating against websites vs. newspapers as FSBO.com never claimed to be a general interest publication. Also, I’d hold off on the celebration sice the 9th Circuit is the most often reversed on appeal and the opinion is based on the bizarre idea that FSBO.com was *not* engaging in commercial speech, an idea which I think they’ll have a hard time defending on appeal.
