Why 13 Isn’t the Number to Avoid

If there is an important number for a small-business owner - besides the bottom line - it is most likely 15. That is the minimum number of employees it takes for federal anti-bias, equal pay and disabilities laws to apply.

“Small-business owners are often quite aware of this,” said Elizabeth A. Gaudio, a lawyer for the National Federation of Independent Business Legal Foundation, who advises owners on how to comply with federal laws and regulations. “To avoid legal troubles, they often keep their numbers under 14.” This year Jodi and Jason Vanderhoof, who own Vanderhoof Outdoor Services, a landscaping and lawn-care service in Texarkana, Tex., downsized to 13 from 18 full-time employees.

    Congress should pass no law that exempts themselves from compliance.

    I’m sure this is another one that causes businesses to alter their plans based on compliance costs not the business efficiency.

    This law subsidizes the litigous who want to get ahead by complaining while penalizing those who would prefer to get ahead by working.
