Burger King Settles Franchisee Litigation

Burger King and its franchisees agreed to put an end to litigation over the company’s right to dictate value menu pricing.

The litigation in Miami federal court between the Miami fast-food chain and the National Franchisee Association had stretched back to Nov. 2009. At the heart of the fight was Burger King’s decision to force the franchisees to sell the $1 double cheeseburger from Oct. 2009 until April 2010, which franchisees claimed was a money loser.

As a condition of settling the litigation, Burger King agreed to a new policy for deciding what items will be placed on the value menu and at what pricing. The new policy allows for more input from franchisees into the process.
