Burger King Settles With Miami Franchisee

Burger King agreed this week to settle a lawsuit with Miami franchisee Al Cabrera over his failure to install new cash registers in time to meet the fast-food chain’s deadline.

The fast-food chain had been trying since last year to shut down 10 of Cabrera’s Miami restaurants because he failed to install new cash registers as required by the deadline of Dec. 31, 2009 or after a warning that gave him until Feb. 12, 2010. Cabrera did end up installing the new system by April 2010.

But Burger King initially backed off on the efforts to shut down six restaurants and after losing a request for a temporary injunction against Cabrera, Burger King’s new ownership and management team apparently had a complete change of heart. The litigation against Cabrera began before Burger King was sold last year to 3G Capital who brought in a new management team.
