Gino’s East Sues Highland, Mishawaka Franchisees

Gino’s East is suing a Highland and Mishawaka franchisee for copyright infringement, claiming the locations have continued to use the company’s branding after it terminated the franchise agreements weeks ago.

Gino’s East Services LLC filed the federal civil suit Monday evening against Shamrock Management Group of Highland LLC and Gino’s East Pizza of Mishawaka LLC.

According to the complaint, the company claims the two location failed to pay the royalty fee of 5 percent of its weekly gross sales and the annual fee of 1 percent of its gross sales.

Gino’s East terminated the defendants’ franchise agreements in February, according to the complaint, but the Highland and Granger locations have continued to operate under its branding.
