The disclosure document is the centrepiece of franchise law in Canada. In those provinces which have franchise legislation, franchisors are required to provide prospective franchisees with a sufficient amount of background on the system via the disclosure document so that those prospects can make informed investment decisions about whether they want to become a franchisee or not.
One of the tenets of franchise law is that, while containing all the requisite pieces of information which the legislation requires, disclosure documents must also be “clear and concise.” Conciseness is generally anathema to lawyers, and those who practice in franchising are no exception. As a result, it is not uncommon to come across disclosure documents that are anywhere from 100 – 400 pages long, depending on the number of attachments to the main document. Full article.

Husband and wife partners, Michele and Gennaro DiMeo, owners of Maryland-based Squisito NY Pizza & Pasta, have opened their first franchised location.
The fast casual Italian brand joined forces with Fransmart, the franchise development company behind brands such as Five Guys Burgers and Fries, Qdoba Mexican Grill and zpizza, to develop the concept in strategically selected U.S. markets.
The first franchise location in Burtonsville, Md., is owned by John Minnick, a retiree from U.S. Homeland Security.
“We were having a soft opening for family and friends, and people were just walking in to our soft opening. After awhile, we couldn’t turn them away – so we began selling the night of our soft opening,” Minnick said.

Bo South Tennessee Inc., a Bojangles’ franchisee for the past 21 years, will open its eighth location Sept. 25 in Chattanooga, Tenn.
The new, 3,808-square-foot Bojangles features drive-thru and in-store dining beginning with breakfast and continuing through dinner late into the evening.

Showing early signs of mirroring the wild success of its sister brand in Canada, Boston’s Restaurant & Sports Bar announced today three new franchise agreements that will result in 11 new restaurant locations throughout the United States and Mexico.
The new franchises, part of an ongoing franchise expansion effort that targets multi-unit operators, calls for franchisees Jorge and Joaquin Ocampo to open seven locations in Mexico, specifically in Veracruz, Tabasco and Campeche. In addition, the Torrado family, which already operates 2 Boston’s Restaurant & Sports Bar locations in Mexico, will add three new locations there, one each in Chiapas, Puebla and Quintana Roo. Meanwhile, in Michigan, franchisee Claude High will open a new location in Grand Blanc Township, which comes after an announcement earlier this year that franchisee Rrok Dedivanaj will open a new Boston’s Restaurant & Sports Bar in Fenton, Mich. Gerard Pickhardt, a former aerospace manufacturing executive from Sarasota, is doing his part to spice up Tampa Bay’s economy, one new restaurant at a time.
Pickhardt and his wife, Bonnie, bought bay area franchise rights for the Orlando-based Flippers Pizzeria chain, and they plan to open their first location on N Fourth Street in St. Petersburg Dec. 1, followed by a second restaurant in Carrollwood in April and another one six months later at Dale Mabry Highway and Kennedy Boulevard in Tampa. Barberitos Franchising, Inc. announced the opening of its 29th restaurant location in Asheville, NC. The new store opened September 14, 2012.
New franchisees, Timm and Kate Phillips, from the High Point, NC area decided to open a Barberitos location in Asheville after frequenting the Barberitos in High Point. The new store is located at 1856 Hendersonville Rd., Asheville, NC in the Earth Fare Shopping Center. The Southwestern Grille offers alcoholic beverages, free wireless for customers, and outdoor seating. In addition, kids eat free (with the purchase of an adult entrée) on Mondays after 4 PM.
“We are excited to be bringing Barberitos’ healthy food and fun atmosphere to Asheville” said owner, Timm Phillips. “We’re glad to be joining the Barberitos team and are thrilled to finally have our doors open.”

In their bid for office, the Conservative Party in the United Kingdom staked a great deal of their political capital on restoring public confidence in the quality of the education system. In tandem with measures to improve training and attract higher calibre entrants to the teaching profession, a key strategy for achieving that objective has been to introduce greater autonomy to the system so that headteachers can act to address poor performance and teaching professionals are treated as such.
Strange then, that when it comes to key stage four curriculum and assessment reform, the British government has adopted exactly the reverse of this approach. Full post.

Little Sunshine’s is a for profit preschool and daycare center. The company was started by a 21-year old entrepreneur in 2005.
In 2009 they filed suits against two of its franchisees for unpaid royalties. Those franchisees sued back claiming breach of contract and lack of support.
The suits were settled in court and Little Sunshine’s has assumed the operations of the two franchisees.
Now the company is seeking more franchisees and is trying to overcome the fallout from the franchise lawsuits.
