Marin Prosecutors Obtain Settlement With Subway

Prosecutors in Marin and two other counties announced a $645,000 settlement with the Subway sandwich chain Friday over complaints of overcharging and misleading advertising.

Authorities filed a civil action against the company after customers reported that advertised promotions – such as “Sandwich of the Day,” “Make it a Meal” and Make it a Footlong” – were not being properly honored at the counter.

The complaints prompted an investigation by state and local regulators, who alerted the district attorney’s offices of Marin, Sonoma and Santa Cruz counties. Investigators found that some Subway stores were not granting advertised discounts for food combinations, or failing to “clearly and conspicuously disclose” restrictions on the offers.

Robert Nichols, a Marin prosecutor who specializes in consumer protection, said Subway customers were being deprived of up to $1 per order in promotional discounts. He did not know how many Marin residents might have been affected.
