GMAC Sues Allegiant Realty

A defunct Wichita real estate firm is being sued by its national franchiser for allegedly using GMAC logos after the local franchise was terminated.

In a breach of contract and trademark infringement lawsuit filed last month in U.S. District Court for the Northern District of Illinois, GMAC Real Estate LLC alleges that Wichita’s Allegiant Realty, 4601 E. Douglas, continued to use GMAC’s registered logos after the franchise was terminated in July.

The suit alleges that the franchise has been in default since 2006. It is seeking almost $575,000 from the company in damages, lost future revenue and back franchise fees.

Allegiant president Andy Skubitz closed the agency in late fall. He and his mother, Betty, a minority stockholder in the company, are co-defendants in the suit.

Contacted Monday, Skubitz referred questions to his Wichita attorney, Scott Pohl.

But when asked whether he agreed with the contention that Allegiant had misused the GMAC Real Estate logos, Skubitz said, “Not really.”
