Dunkin’ Donuts Case In Court

A lawsuit challenging the town’s denial of a Dunkin’ Donuts store at the former site of Corey’s hot dog stand is scheduled to go to trial Wednesday.

“In my opinion, the owner of the property is entitled to the permit,” said Franklin Pilicy, a lawyer representing the applicants.

In 2009, the town’s former zoning enforcement officer denied franchisee Joseph Naples a permit to open the store, a decision eventually upheld by the Zoning Board of Appeals. Naples and property owner Thomas Briggs appealed that decision in Waterbury Superior Court. Barring a pretrial settlement, the case will be assigned to one of three judges for a hearing Wednesday morning. Read more.
