Leslie Smith, a franchise attorney and partner with Foley & Lardner in Miami, tells the story of a bakery owner whose small business was so successful she decided to franchise it. After some initial investigation, she discovered that a well-known bakery in another state already had the name she had been using for her small enterprise.

“She wasn’t able to grow her business based on her name,” Smith said.

“It can be a successful enterprise, but also a terribly disappointing enterprise if you don’t plan carefully,” Smith said of franchising.
