Eric and Faith Willoughby’s Maid-Rite franchise opened in Maryville, Missouri, in May 2011. By May of this year, the restaurant had shuttered and the Willoughby family felt duped. According to a lawsuit filed in federal court in Kansas City, Missouri, yesterday, the former Maid-Rite franchisees are suing the company, alleging fraud and breach of contract over what they contend was an out-of-date Franchise Disclosure Document (FDD).
The lawsuit maintains that the FDD was two years old and failed to show the material change in Maid-Rite’s finances, as well as an apparent decline in the average ticket price for diners.
