Both Sides Vie For Edge In Pizza Hut Lawsuits

Both sides in $1 million litigation against Greenwood’s Pizza Hut are straining to gain an edge in a judicial tug-of-war that will determine where the case is tried.

A federal trial is scheduled to begin Sept. 7 in Greenville.

However, four lawsuits including two that remain in Leflore County Circuit Court are pending in the case that involves allegations of food poisoning.

A judge ruled this month against a request by NPC International, the Pizza Hut franchisee, to delay the county proceedings until the federal trial is finished.

The four lawsuits all allege that 19 church members got sick after eating at the restaurant on Jan. 18 because Pizza Hut was negligent in preparing the food.
