A national discount retailer is suing a former Eastern Passage franchisee for alleged breach of contract for opening a similar dollar store nearby this spring.
Great Canadian Dollar Store (1993) Ltd. filed a notice of action in Nova Scotia Supreme Court on Thursday against two numbered companies, 3179354 Nova Scotia Ltd. and 3247135 Nova Scotia Ltd., and a Dartmouth couple, Gary and Ruby Janes.
In a statement of claim, Great Canadian, which is based in Victoria, B.C., alleges the couple and their companies breached a December 2006 franchise agreement by opening a Maritime Dollar Store Plus store in Woodside in April.
Gary Janes is president of 3179354 Nova Scotia Ltd., which operated the Eastern Passage location of Great Canadian until the end of April, the claim says.
At that time, the franchisee sold the business to a third party, court documents say. More.
